Clothing manufacturer sued over allegations of deceptive marketing

Jeans

A Kennebunk, Maine woman is suing a clothing manufacturer and retailer over claims its jeans were deceptively marketed and labeled.

Maya Schulert, individually and for all others similarly situated, filed a class action complaint July 16 in U.S. District Court District of Maine against Hudson Clothing LLC, alleging deceptive trade practices, negligent misrepresentation, breach of warranty and unjust enrichment.

The complaint states that in August 2013, Schulert bought Hudson jeans from Nordstrom Rack in South Portland, Maine, observing that the jeans were marked "Made in USA." and labeled "Made in Los Angeles USA."

Schulert believed she was supporting American jobs and economy in purchasing the jeans, but the claim alleges that the "Made in USA." representations were false, deceptive, and misleading, and that the jeans were in fact manufactured with substandard foreign-made parts.

Schulert and others in the class seek damages and court costs, as well as an order requiring the defendant to cease and desist.

Schulert is represented by Robert Edmond Mittel and Michael P. Asen of Mittel Asen LLC in Portland, Maine; Erica C. Mirabella of Mirabella Law LLC in Boston; Jonathan W. Cuneo and Taylor Asen of Cuneo Gilbert & Laduca LLP in Washington, D.C. and Brooklyn, NY; and John Donboli of Del Mar Law Group LLP in San Diego.

U.S. District Court District of Maine case number 2:15-cv-00276-JDL.
