SAN DIEGO (Legal Newsline) - A San Diego woman is suing a health software and systems corporation, alleging it negligently handled a security breach, resulting in compromised personal information stored in its databases.
Terri Greulich, individually and for all others similarly situated, filed a class action lawsuit Aug. 6 in U.S. District Court Southern District of California against Medical Informatics Engineering Inc. (MIE), alleging negligence, breach of implied contract and unlawful business practices.
According to the complaint, Greulich received a letter from MIE dated July 17, informing her of a security breach in one of MIE's servers. The suit says Greulich's personal information was accessed and seized by unauthorized sources as a result of the breach, and, as a result, suffers imminent and impending injury from risk of future fraud and identity theft.
Greulich and others in the class seek an injunction requiring MIE to maintain adequate security measures, plus damages, restitution, disgorgement, attorney fees and court costs. The plaintiff is represented by attorneys Timothy G. Blood, Thomas J. O'Reardon II, and Paula M. Roach of Blood Hurst & O'Reardon in San Diego, and attorneys William B. Federman and Carin L. Marcussen of Federman & Sherwood in Oklahoma City (pending pro hac vice).
