Porsche sued over alleged dashboard defect

LOS ANGELES (Legal Newsline) - Roy Jones and Alyce Rubinfeld are suing Porshe over claims it concealed information regarding defective beige dashboards.

The two California residents, individually and for all others similarly situated, filed a class action complaint in Superior Court of California for Los Angeles County against Porsche Cars North America, alleging unfair competition, breach of implied warranty, and unjust enrichment.

The defendant removed the case to federal court on July 30.

The complaint states that Porsche manufactures vehicles featuring beige-colored dashboards that cause an unsafe glare or reflection on the vehicles' windshields, impairing driver visibility and posing a clear safety risk.

According to the complaint, Porsche knew or should have known about the windshield glare problem through early consumer complaints, including documented complaints to the National Highway Traffic Safety Administration.

The complaint states that Porsche concealed or omitted information regarding the glare problem to consumers, including the plaintiffs and other class members, and has not recalled the defective vehicles.

Roy Jones purchased a Porsche vehicle on March 20, 2014, and Alyce Rubinfeld purchased a Porsche vehicle on Aug. 25, 2013. Both vehicles were equipped with the beige dashboard, and both parties experienced and continue to experience the window glare problem in their vehicles, the complaint alleges.

They seek an order compelling Porsche to recall vehicles with beige dashboards and to repair or replace these features. They also seek damages including interest, plus court costs.

They are represented by Jordan L. Lurie, Robert Friedl, Tarek H. Zohdy, and Cody R. Padgett of Capstone Law APC in Los Angeles.
