Jogger alleges Adidas running shoe has defects

A Westchester County man is suing Adidas, alleging its SpringBlade shoe is defectively designed and manufactured.

Edward A. Ruffo, individually and for all others similarly situated, filed a class action lawsuit July 30 in U.S. District Court Southern District of New York against Adidas America Inc., alleging breach of implied warranty, unjust enrichment and deceptive and unlawful business practices

According to the complaint, Ruffo bought SpringBlade shoes, a recent Adidas release marketed as "cutting edge" and the result of over six years of development and testing, on adidas.com and amazon.com, and at Dick's Sporting Goods.

The suit says after only a few days of treadmill running, the bonding on the sole of each pair of Ruffo's shoes began to fail, specifically between two semi-rigid components at the forefoot flex area. Ruffo says he tried to get a refund but Adidas did not respond to his calls. He then found similar defect complaints posted online from other SpringBlade consumers across the country and abroad, the lawsuit states.

Ruffo and others in the class seek restitution and injunctive relief, plus court costs.
