SAN JUAN, Puerto Rico (Legal Newsline) - Christian Garcia-Catalan is suing Johnson & Johnson, a large consumer health care products company, over claims its Bedtime baby products are falsely, deceptively, or misleadingly advertised.
Garcia-Catalan, individually and for all others similarly situated, filed a class action complaint July 23 in U.S. District Court for the District of Puerto Rico against Johnson & Johnson Consumer Cos., alleging false advertising.
Over the last four years, Garcia-Catalan has been purchasing Johnson & Johnson Bedtime baby products, which, according to the complaint, claim to be "clinically proven" to help babies sleep better.
However, the complaint alleges that these products are not "clinically proven," and as a result, consumers pay a higher price for products that they believe will help their babies sleep better, but in fact they may not.
Garcia-Catalan and others in the suit seek injunctive relief, actual damages, restitution and/or disgorgement of profits, statutory damages, plus court costs. He is represented by Jose R. Franco-Rivera of San Juan.
