LOS ANGELES (Legal Newsline) - A Los Angeles County woman is suing Blue Apron, alleging unlawful and deceptive business practices.
Lisa Riccobono, of Westlake, as an individual and for all others similarly situated, filed a class action lawsuit June 9 in California Superior Court County of Los Angeles against Blue Apron Inc., alleging unlawful, unfair, and deceptive business practices related to automatic subscription renewal on the company's website.
The defendant removed the case to U.S. District Court for the Central District of California on July 21.
According to the complaint, on Jan. 11, Riccobono purchased a subscription from Blue Apron's website and was charged for automatic renewal of the service without her consent, in violation of California's Automatic Purchase Renewal Statute.
Riccobono alleges Blue Apron did not clearly present automatic renewal and continuous service offer terms, resulting in further charges on her credit card.
The lawsuit states the number of other members in the class could be in the hundreds of thousands.
Riccobono and other class members seek damages and/or full restitution in the amount of their subscription payments, plus court costs. She is represented by attorneys Abbas Kazerounian and Mona Amini of Kazerouni Law Group in Costa Mesa, Calif., and Joshua Swigart and Sara Khosroabadi of Hyde & Swigart in San Diego.
