SEATTLE (Legal Newsline) - One of the country's largest cellphone service providers is being sued by former employees who claim the company failed to pay them the full commission they earned.
Dana Rohde and Michael Wilson filed the lawsuit May 15 in Washington Superior Court against T-Mobile USA alleging the company deliberately failed to pay the wages. The defendant removed the case to federal court on June 29.
The plaintiffs were employed at T-Mobile stores in Washington. Rhode started in February 2011 and Wilson began in February 2012. Both left in December 2014. Both said in the lawsuit they have yet to receive their full commission they earned by selling goods or services to customers.
The lawsuit said T-Mobile violated state wage laws by withholding the commissions.
The lawsuit seeks to class status for all Washington employees of T-Mobile who failed to receive their full commission between May 15, 2009, and the present. The plaintiffs are also seeking restitution for twice the amount of the commission withheld, as well as an unspecified amount in damages, plus court costs for filing the lawsuit.
