Foreclosure consultant settles claims it misled Spanish-speaking customers

PHOENIX (Legal Newsline) - Brother’s Help Solutions, a foreclosure consultant, will pay a settlement and restitution to Arizona consumers after a consent judgment was reached Jan. 15, Arizona Attorney General Mark Brnovich said.

The foreclosure consultant will pay $20,000 in penalties and restitution to consumers, in addition to $9,450 in investigation costs, after the company allegedly misled Spanish-speaking consumers. In addition to monetary fines, the company will have to ensure it complies with the Arizona Consumer Fraud Act.


Brother’s Help Solution, which is owned by Nelson Melano, allegedly gave misleading directions to Spanish-speaking consumers by having them sign a contract that was in English, in addition to leaving out information in the application process, miscommunicating the complications of loan modifications and asking for payment up front, which violates the Arizona Foreclosure Consultant Stature.

“My office fights to protect all consumers from fraud in our community,” Brnovich said. “If you have been a victim of deceitful businesses practices, we encourage you to bring that information to our attention.”

A lawsuit was filed against Brother’s Help Solution on Nov. 12 that also alleged that the company cashed and changed checks that were to be given to their clients' lenders.
