MARSHALL, Texas (Legal Newsline) - A Plano, Texas, company last week filed lawsuits against various online ticket and gun marketplaces, claiming patent infringement.
Plaintiff CYVA Research Holdings LLC -- for which no website could be found -- filed its lawsuits in the U.S. District Court for the Eastern District of Texas Friday.
The federal court has become a popular venue for patent infringement cases because of its set of local rules for such cases and rather fast trial settings.
The named defendants are Vivid Seats Ltd., which is based in Chicago; Ticket Liquidator LLC, Ticket Software LLC and Ticketnetwork Inc., all of which are based in Connecticut; and Gunbroker.com LLC, which is based in Georgia.
Vivid and Ticket allow fans to buy and sell tickets to sports, concerts and theater events nationwide. Gunbroker allows consumers to purchase or sell guns and firearms.
According to CYVA’s complaints, it is the owner of U.S. Patent No. 8,195,569 titled, “E-bazaar featuring personal information security.”
The patent was issued in June 2012.
CYVA argues that the websites are infringing on the ‘569 patent by providing an “electronic bazaar,” an advertiser client and a buyer client, “both configured to send one or more items of personal information, a product database and an electronic broker that provides trusted processing of transactions, ensuring that the rules governing the buyers and sellers personal information are satisfied.”
It is seeking a permanent injunction enjoining the defendants from infringement; an order requiring the defendants pay CYVA damages, costs, expenses, and pre-judgment and post-judgment interest.
CYVA also is asking for an accounting of post-judgment infringement and a jury trial.
The lawsuits have been assigned to Judge Rodney Gilstrap, according to the case dockets.
