MARSHALL, Texas (Legal Newsline) - A Texas-based company is suing nearly a dozen electronics manufacturers, including BlackBerry, HTC, Microsoft, LG, Motorola, Samsung and Sony, for patent infringement.
Magnacross LLC, which, according to its complaint, is located in McKinney, Texas, filed its lawsuit in the U.S. District Court for the Eastern District of Texas Oct. 15. The federal court has become a popular venue for patent infringement cases because of its set of local rules for such cases and rather fast trial settings.
The named defendants include: Best Buy Purchasing LLC d/b/a Insignia Products, BlackBerry Corp., Fujitsu America Inc., HTC America Inc., LG Electronics USA Inc., Microsoft Corp., Motorola Mobility LLC, Samsung Electronics America Inc., Sony Electronics Inc. and ZTE (USA) Inc.
Magnacross is accusing the defendants of infringing on U.S. Patent No. 6,917,304.
According to the company’s complaint, the ‘304 patent was issued to it in July 2005.
The patent is for a Wireless Multiplex Data Transmission System.
Magnacross alleges that the defendants have been infringing on the ‘304 patent through their smartphones, tablets, Bluetooth headphones, activity trackers, smart watches and similar devices.
The company -- for which a website could not be found -- is seeking compensatory damages no less than a reasonable royalty, interest, costs, injunctive relief and other relief deemed just and proper. It also is demanding a jury trial.
Attorney David R. Bennett of Direction IP Law in Chicago, Ill., is representing Magnacross.
Judge Rodney Gilstrap has been assigned the lawsuits.
