INDIANAPOLIS (Legal Newsline) - Indiana Attorney General Greg Zoeller has filed a lawsuit against KC Driving School and its owner, Kimberly J. Cleeter.
Zoeller's lawsuit seeks a permanent injunction, consumer restitution, civil penalties and investigative costs and alleges it collected payments from potential customers while failing to provide driver education services, which violates the state’s Deceptive Consumer Sales Act.
The Dearborn County driving school did not give instruction services it was paid for or gave instruction without the required Bureau of Motor Vehicles (BMV) certification, according to consumer complaints.
“More than two dozen families filed complaints with my office against KC Driving School for taking up-front payments and not delivering services,” Zoeller said. “After investigating the company with help from the Aurora Police Department, it became clear that the company had no intention of continuing to offer licensed driver education or of repaying its customers.”
The school’s license with the state expired on June 30, and the company declined to renew its certification, ceased operating and allegedly left customers without services or refunds. Customer service representatives from KC Driving School allegedly falsely represented to customers that it was working with the BMV to obtain its license.
The Attorney General’s Office is still accepting consumer complaints against KC Driving School and/or Cleeter.
