California clothing store cited for 'false' pricing

A California clothing store has been sued over allegations it falsely advertised the pricing of its merchandise.

Theresa Metoyer filed a lawsuit May 22 in U.S. District Court Central District of California Eastern Division against Tween Brands Inc., alleging the company mislead consumers over the original prices and sale prices of its apparel and merchandise.

The lawsuit alleges consumers were part of a direct marketing campaign by Tween, and the advertisements were false for at least four years. Metoyer says on at least five different visits to the store she purchased products that were marked as 40 percent off regular price.

“The marked original or regular prices for the products which [Metoyer] purchased from [Tween] were not true original or regular prices,” the lawsuit said.

Metoyer seeks class status for those who purchased clothing from Tween over the last four years, more than $5 million in damages, plus court costs. She is represented by attorneys Douglas Caiafa of Douglas Caiafa, a professional law corporation in Los Angeles; and Christopher J. Morosoff of the Law Office of Christopher J. Morosoff of Palm Desert, California.
