Patent lawsuit against Mercedes Benz dismissed

NEWARK, N.J. (Legal Newsline) - A New Jersey federal judge has dismissed a patent infringement lawsuit against luxury car maker Mercedes Benz.

The lawsuit brought by Ibormeith IP LLC claimed the luxury car maker's "Attention Assist," which detects when vehicle or machine operators are becoming too drowsy to safely perform their duties, was an infringement of Ibormeith's patent.

Judge Faith Hochberg of the U.S. District Court for New Jersey said that while the Ibormeith patent claims to patent an algorithm that computes the changes in a driver's behavior that is essential in determining the ability to operate the vehicle, it "fails to disclose the steps necessary to actually perform that suggested algorithm."

The lawsuit was initially filed in October 2010. The "Attention Assist" is an option available in some Mercedes cars.
