TOPEKA, Kan. (Legal Newsline) - Kansas Attorney General Derek Schmidt announced fines of $50,000 against two construction companies from outside the state on Wednesday for allegedly violating the Kansas No-Call Act.
The Omaha, Neb.-based Walley's Heartland Construction agreed to a $10,000 consent judgment with the state, which also received a $40,000 judgment format he Golden, Colo.-based Countrywide Shingle and Siding.
"The privacy wishes of Kansans who register on the Do-Not Call list should be honored," Schmidt said. "We take seriously violations of the No-Call Act and our obligation to enforce the law."
The consent judgment against Walley's Heartland Construction requires the company to pay $10,000 in fees and penalties to resolve allegations that it violated the No-Call Act. Schmidt's Consumer Protection Division looked into the company after receiving a complaint from a Topeka homeowner in June 2011.
Schmidt's office alleged that the company solicited more than 1,300 Kansas consumers by telephone last summer after damaging storms in Northeast Kansas. Many of the callers were allegedly on the Do-Not-Call list.
Countrywide Shingle and Siding was the subject of three No-Call complaints from consumers in Johnson County. The consumers alleged that they were solicited by Countrywide for roof inspections in August, even though they were registered on the Do-Not-Call list.
