MADISON, Wis. (Legal Newsline) - Wisconsin Attorney General J.B. Van Hollen announced an enforcement action on Tuesday against an Outagamie County-based window and door retailer for allegedly violating the state's No Call Law.
Creative Openings, a replacement doors, windows and siding retailer, allegedly failed to register particular telephone lines as lines for telemarketers, a requirement in the state of Wisconsin. The company also allegedly made hundreds of thousands of telephone solicitation calls to residents of the state who were registered on the state's No Call List.
"Since 2004, 89 consumers have filed complaints with DATCP involving Creative Openings' telemarketing practices, including violations of the state's No Call Law," the lawsuit said. "Thirty-eight of those complaints have been received since January 1, 2011. Despite being informed of the no call complaints against it, Creative Openings has failed to modify its practices to come into compliance with the No Call Law."
The lawsuit seeks to enjoin Creative Openings from further no call violations and assess forfeitures of up to $100 for each call made to numbers on the list. In addition, the suit seeks fees and costs associated with the prosecution.
