DES MOINES, Iowa (Legal Newsline) - Iowa Attorney General Tom Miller announced a $160,000 consent judgment against a West Des Moines contracting company on Friday for allegedly violating Iowa door-to-door sales and consumer fraud laws.
Polk County District Court Judge Brad McCall issued the court order against IQ Renovation LLC and owners Timothy Marlow and Megan Troyer Marlow. Timothy Marlow also operated under the name Energy Savers and has previously listed company addresses in Clive and West Des Moines, Miller says.
In addition to the $160,000 reimbursement to customers, the defendants are barred from future residential contracting business and are restricted in their commercial contracting business.
Miller filed a lawsuit against the defendants on June 2, 2011, after receiving dozens of consumer protection complaints about IQ Renovation and the Marlows.
"We don't take it lightly when we ask a judge to forbid or even restrict someone from doing business," Miller said. "But in this case, because of the long and established pattern of misrepresentations and other misconduct to a large number of consumers, we felt this is clearly in the public's best interests.
"Though the defendants denied wrongdoing, our office took this unusual step to protect Iowa consumers."
Timothy Marlow signed an assurance of voluntary compliance in 2004 as the operator and owner of Epic Homes LLC. The company was not registered with the state and was the subject of more than three dozen complaints filed with the Consumer Protection Division, Miller says.
