PIERRE, S.D. (Legal Newsline) - South Dakota Attorney General Marty Jackley, along with the state Department of Labor and Regulation, is warning businesses to steer clear of so-called "poster scams" from companies selling federal agency postings.
Jackley said Thursday that the companies often will use scare tactics -- warning businesses of potential fines and penalties -- to make a sale.
The solicitations, he said, have an official-looking seal to create the impression that the advertisement is an official communication from a government entity.
"These unscrupulous companies use notices to mislead businesses into thinking the government is contacting them and threatening a fine if they don't purchase these posters," the attorney general said in a statement.
"Labor law posters that businesses are required to display can be obtained from the South Dakota Department of Labor and Regulation at no cost."
According to Jackley's office, businesses can get the posters from any local DLR office.
The labor law compliance poster includes the six federal posting requirements. Various federal agencies, such as the U.S. Labor Department, Occupational Safety and Health Administration, and Equal Employment Opportunity Commission, have posting requirements.
There are also two state posting requirements. The Division of Unemployment Insurance requires a posting, which can be obtained online. State workers' compensation law also requires a posting encouraging workplace safety; however, there is no required format.
