SPRINGFIELD, Ill. (Legal Newsline) - Illinois Attorney General Lisa Madigan announced an agreement on Monday with an Iroquois County swine facility that allegedly discharged livestock waste into Spring Creek, polluting the water and killing thousands of fish.
The consent order with R3E LLC, filed Monday in the Circuit Court of Iroquois County, partially resolves an amended complaint Madigan filed in February 2010.
The company is required to pay $63,782 to the Illinois Department of Natural Resources for the value of the aquatic life destroyed by waste discharge and $17,500 in civil penalties to the Illinois EPA's Environmental Protection Trust Fund. More than 110,000 fish were allegedly killed across over 19 miles of Spring Creek and a tributary.
"We value the vast natural resources we have here in Illinois," Madigan said. "It is critical that we protect our water and wildlife and ensure that these precious resources are restored whenever they have been polluted."
Jane McBride, the senior assistant attorney general, is handling the case for Madigan's Environmental Bureau in Springfield. Madigan's office continues to pursue claims of natural resource damage for the costs of restoring the stream.
