Suit alleges doctor didn't know risks of exam table

CHARLESTON, W.Va. (Legal Newsline) - A Kanawha County woman is suing a Charleston physician she claims is responsible for injuries she sustained when she fell from an examination table.

On Nov. 1, 2010, Marilyn Schechter was injured when she fell from an examination table while under the care of Dr. David J. Patton, according to a complaint filed Oct. 24 in Kanawha Circuit Court.

Schechter claims the defendant failed to properly assess the risks and in allowing her to get off the examination table without any assistance.

The defendant's actions caused Schechter to incur injuries to her right knee and other parts of her body, according to the suit.

Schechter claims the defendant's negligence caused her to sustain severe and permanent injuries; mental anguish; and disfigurement and deformity.

The defendant's actions also caused Schechter to be hospitalized and incur medical expenses, according to the suit.

Schechter is seeking compensatory damages. She is being represented by Stephen P. Meyer.

The case has been assigned to Circuit Judge Louis H. Bloom.
