Injunctions filed against telemarketers

JEFFERSON CITY, Mo. (Legal Newsline) - Missouri Attorney General Chris Koster obtained preliminary injunctions on Monday against two telemarketing companies for allegedly making solicitation calls to Missourians on the state's no-call list.

The injunctions were obtained against the St. Louis-based Outsourcing and Communication Consultants and owners James Radtke and Vivi Radtke and the Salt Lake City-based CallAssistant. The lawsuits came as a result of numerous complaints filed with the No-Call unit of Koster's office.

Koster filed lawsuits against the companies alleging violations of the Telemarketing No-Call List Act and the Missouri Merchandising Practices Act. Outsourcing allegedly made telephone solicitation calls to consumers in which the telemarketers promised consumers lower rates on credit cards. CallAssistant allegedly contacted consumers in an attempt to solicit enrollment for an online college or interest in a home security system.

"When Missourians register with our No-Call list, they do so with the reasonable expectation that they will not receive these unsolicited, harassing calls," Koster said. "These businesses are aware of our No-Call laws, and they are realizing that this office will enforce those laws."

The court has prohibited the defendants from making calls to Missourians on the no-call list. Koster's lawsuit is requesting that the court impose a civil penalty of $5,000 for each violation of Missouri law, prosecution costs and all court costs.
