CONCORD, N.H. (Legal Newsline) -- New Hampshire Attorney General Michael Delaney, in response to a lawsuit filed by 10 state hospitals, says federal Medicaid law cannot overrule the state's laws.
The hospitals are challenging a reduction in Medicaid reimbursements, the Concord Monitor reported.
According to the newspaper, 10 of the state's 13 largest hospitals sued the state in July after the Legislature passed a budget that cut Medicaid funding by $115 million over two years.
The hospitals argue the Legislature's reduction violates federal law requiring health care access to the poor.
In the state's motion to dismiss filed Sept. 23 in Merrimack County Superior Court, Delaney contends the hospitals haven't shown "irreparable injury" as a result of the cuts.
