CONCORD, N.H. (Legal Newsline) - New Hampshire Attorney General Michael Delaney announced Tuesday that his office has filed a lawsuit against a housing developer that allegedly violated the Land Sales Full Disclosure Act and the Consumer Protection Act.
Brady Sullivan Paugus Woods LLC allegedly violated the laws by selling homes at the Villas at Paugus Bay subdivision. Delaney alleged that many of the homes in the subdivision were not in compliance with basic building and safety codes when they were sold to their buyers. The alleged faults range from violations of electrical and building codes to failure to bolt home modules together as required by home manufacturers.
In court filings, Delaney alleges that the violations cited render the homes potentially hazardous to their occupants. Delaney also alleges a violation of the Consumer Protection Act because Brady Sullivan published a public offering statement that explicitly stated that all homes in the subdivision met all applicable building and housing codes when they did not.
"This office takes its obligation to protect consumers seriously," Delaney said. "Failure to adhere to established building and safety codes in the construction of houses can put families in danger needlessly.
"Along with other local and state agencies that work to ensure that dwellings are safe, we will take action against developers of residential housing who make false statements of material fact to their prospective consumers."
