Wis. AG wins case against mobile home park owner

Van Hollen

MADISON, Wis. (Legal Newsline) - Wisconsin Attorney General J.B. Van Hollen announced a $12,519.60 judgment on Monday against a mobile home park owner in Dunn County, Wis.

Marlin Shafer, the owner of the Shady Oaks Mobile Home Park in New Richmond, allegedly violated state law by providing a public water supply to residents of the park without a certified operator, repeatedly failing to sample and test the drinking water for contaminants and failing to notify residents of the test results from December 2008 to this past December.

A civil complaint filed against the defendant on March 2 led to a judgment in Dunn County Circuit Court on September 1. The court took notice of the defendant's admission of guilt to the charges at a hearing on May 20 and scheduled a penalties hearing for July 19. Shafer will pay $12,519.60 in forfeitures, statutory surcharges and costs.

"The public is entitled to a safe drinking water supply, and the Wisconsin Department of Justice will continue to work with the Department of Natural Resources to ensure that," Van Hollen said.

The defendant was also ordered to provide a certified operator to run the public water system and to comply with all required drinking water resampling, notification and testing requirements.
