DENVER (Legal Newsline) - Colorado Attorney General John Suthers announced on Tuesday that his office has filed a lawsuit against a Florida company and its owner for allegedly engaging in unregistered debt management services.
The Orlando, Fla.-based Enhanced Services Solutions and Thomas Roland, its president, were named in the suit. Suthers alleges that the company provided "back end" debt management services for the Johnson Law Group, another Orlando, Fla.-based company.
Enhanced Servicing Solutions allegedly failed to register with the state of Colorado to comply with the Colorado Debt Management Services Act and the Colorado Consumer Protection Act. The complaint, which was filed in Denver District Court, alleges that Enhanced Servicing Solutions both ignored a December 17 letter from the state apprising it of Colorado's registration requirements and did not respond to a January 25 subpoena.
Suthers filed a lawsuit against Johnson Law Group on April 28 for alleged unlawful debt management practices directed at Colorado consumers.
In the state of Colorado, a debt-management services provider must obtain a certification of registration from the administrator of the Uniform Consumer Credit Code. To obtain this certificate, the provider must supply information about itself, post a surety bond to ensure its compliance with the DMSA, meet specified requirements of competency and obtain insurance against employee dishonesty. Suthers alleges that the company failed and refused to obtain a certificate of registration.
