BALTIMORE (Legal Newsline) - Maryland Attorney General Doug Gansler announced on Thursday that the state Court of Special Appeals has upheld a previous finding by his Consumer Protection Division that a modular home seller violated state laws.
John P. Seisman and his company, Leedom Inc., trading as Modular Home Express, were found guilty of selling modular homes to consumers without being registered as a home builder, which is in direct violation of Maryland's home builder and consumer protection laws.
On May 13, 2008, the division issued an order finding that Seisman and his company didn't comply with the state's Home Builder Registration Act, Custom Home Protection Act and Consumer Protection Act when selling modular homes. At that time, the company was ordered to pay penalties of $809,000.
Seisman and his company, which now goes by the name of Commercial Building Systems, Inc., appealed the finding successfully in the Circuit Court for Baltimore County, which reversed the division's order.
The division then appealed to the Court of Special Appeals, which found that the division's order was supported by substantial evidence and should not have been overturned on appeal.
State law requires all home builders, including sellers and installers of mobile and modular homes, to be registered with the unit before conducting business in Maryland, which Seisman and his company were not.
