Stenehjem issues order against Texas contractor

BISMARCK, N.D. (Legal Newsline) - North Dakota Attorney General Wayne Stenehjem has issued a cease and desist order prohibiting a Texas contractor from doing business in the state.

The order alleges that Bud Daley, the operator of BD Sealcoating of Fort Worth, Texas, operated a business both without a contractor's license and without a transient merchant license.

The order also alleges that Daley, who operated an asphalt maintenance and home improvement repair business, engaged in deceptive practices when soliciting customers.

In October 2009, a consumer filed a report with the Stenehjem's office stating that Daley had agreed to paint their windows and repair a balcony. Daley allegedly accepted $1,500 deposit, but did not do any work on the consumer's home.

The complaint was one of several made against Daley. In February of 2009, Daley allegedly refused to perform repairs to a faulty asphalt job he performed for one customer.

In March, Daley allegedly accepted $7,300 to make repairs to a consumer's roof. Two weeks after the repairs were made, a storm destroyed the building. In a subsequent inspection, it was found that appropriate materials were not used for the job.

If Daley ignores the cease and desist order, he faces fines of up to $5,000 per violation.
