Koster, Bank of America settle

JEFFERSON CITY, Mo. (Legal Newsline) - Missouri Attorney General Chris Koster has settled with Bank of America allegations of state telemarketing violations.

Under the terms of the settlement, Bank of America has agreed to pay the state $195,000 for its part in calls it and third-party affiliates allegedly made to Missouri residents on the no-call list.

"No one is too big to be beyond the law's reach, not even Bank of America," Koster said. "This result sends the message that the law will be enforced fairly, no matter who's on the other side."

Bank of America must also maintain an in-hour comprehensive telemarketing do-not-call program to ensure future compliance with Missouri and federal telemarketing laws.

Among the requirements are having an employee coordinate and be accountable for the telemarketing program, training employees so they are aware of the telemarketing and no-call requirements and maintaining procedures where these issues are reported to an appropriate supervisor in a timely fashion.

"This case is another example of how the Attorney General's Office continues to aggressively enforce our no-call laws," Koster said. "We investigate all complaints received from Missouri consumers, and when appropriate, we take action against the telemarketer in question."
