Coakley cites painting company over payroll violations

BOSTON (Legal Newsline) - Massachusetts Attorney General Martha Coakley has issued three citations against a Dorchester painting company intentionally violating state labor laws.

The Democrat alleges that the company violated the Massachusetts prevailing wage law, as well as statutes related to payroll record keeping and wage and hour laws.

American East Painting, Inc. and its president Anthony C. Celestine are being cited for violations related to painting work performed from June 2008 through August 2008 for the Department of Conservation and Recreation at two public skating rinks located in Hyde Park and Brighton.

Coakley has ordered the company to pay $36,000 in fines and more than $53,000 in restitution, for intentionally failing to pay the prevailing wage to seven employees.

The company also failed to submit true and accurate certified payroll records to the awarding authority, failed to furnish payroll records to the attorney general's office for inspection and failing to pay employee wages in a timely manner.

An investigation into the matter began last year when the AG's office received multiple complaints about the company.
