BOSTON (Legal Newsline) - Home Depot, U.S.A., Inc., will pay nearly $55,000 to resolve allegations the company did not properly calculate vacation benefits for employees.
The settlement comes after a three-year investigation found that from 2005-2007, the company incorrectly paid earned vacation benefits after the closing of its Braintree store, according to Coakley.
Coakley said that beginning in spring 2007, her office began receiving complaints from former employees over the miscalculated of the benefits.
Under the terms of the agreement, Home Depot has agreed to pay $45,000 in restitution to 58 former employees, as well as $10,000 in legal fees to the state.
According to Massachussett's law, an employer is not required to offer vacation time to an employee, but if vacation time is offered to an employee, the employee must be compensated for the unused earned portion of the vacation time upon discharge.
