LAS VEGAS (Legal Newsline) - The parties in Nevada's lawsuit against Tire Works have, by mutual stipulation, agreed to dismiss their respective cases against each other, Nevada Attorney General Catherine Cortez Masto has announced.
The state's original lawsuit against Tire Works on behalf of more than 100 consumers was based on allegations of deceptive trade practices. Those allegations followed a Consumer Affairs Division undercover investigation.
Investigators took one car to three different Tire Works locations and received three different estimates for repair work. With the help of an automotive expert, the investigators found that the estimates amounted to deception, Masto said.
The vehicle used in the investigation was subsequently sold by the Consumer Affairs Division after it referred the case to the Attorney General's Office for prosecution, preventing the parties involved from inspecting the vehicle and depriving Tire Works of the immediate opportunity to clear the company's reputation.
As a result of the sale of the car, Masto voluntarily dismissed the counts in the complaint pertaining to the compliance checks.
During the past legislative session, the Consumer Affairs Division was disbanded and is no longer in existence. The Consumer Affairs Division was the plaintiff in the case.
Additionally, the original lawsuit was based on an investigation and compliance checks that were conducted by the Nevada Consumer Affairs Division, not the attorney general's office.
In an assurance of compliance entered into by Tire Works, the company has agreed to act in accordance with all requirements under Nevada law pertaining to the repair of automobiles.
"As far as my office is concerned, this settlement brings this matter to a conclusion," Masto said.
