MADISON, Wis. (Legal Newsline) - Wisconsin Attorney General J.B. Van Hollen announced a judgment on Wednesday against Wisconsin Electric Power Company to resolve allegations of air pollution violations at its Kenosha County electric generation plant.
Van Hollen's office filed a civil complaint against Wisconsin Electric Power Company in Kenosha County Circuit Court alleging the company replaced design blades on two turbine units in violation of Wisconsin air pollution regulations. Utility companies are not permitted to make major modifications on turbine units that could potentially impact air contaminant emissions.
Stack tests conducted by the Wisconsin Department of Natural Resources in June 2012 allegedly indicated that nitrogen oxide emissions from each of the modified units were out of compliance with applicable legal limits.
Kenosha County Circuit Court Judge Bruce Schroeder signed the judgment on Monday. Under the terms of the judgment, Wisconsin Electric Power Company must pay $50,000 in statutory forfeitures and penalties. The facility is now in compliance with Wisconsin air pollution laws.
Cynthia Hirsch, the assistant attorney general, prosecuted the case for Van Hollen's office.
