Wisconsin AG obtains $80,000 judgment against mining company

MADISON, Wis. (Legal Newsline) - Wisconsin Attorney General J.B. Van Hollen announced an $80,000 judgment last week against the operator of a Marshfield hydraulic fracturing sand processing facility for allegedly violating air pollution control laws.

Completion Industrial Minerals LLC allegedly failed to update its construction permit application to reflect changes during the construction process, continued to build its facility after its permit expired, failed to prepare and submit a fugitive dust plan to the state within 60 days of permit issuance, failed to keep daily records of precautions taken to prevent fugitive dust, failed to install and operate a continuous emission monitor and failed to prepare and submit a malfunction prevention and abatement plan for its facility to the state.

The majority of the alleged violations occurred around the time Completion's facility began operating. The company cooperated with the Wisconsin Department of Natural Resources and addressed the alleged violations. Completion later made modifications to reduce its particulate matter emissions.

Air pollution control permits and regulations minimize emissions through requirements of control equipment abatement plans and preventative maintenance to reduce accidental releases. Uncontrolled air emissions can threaten the environment and human health, including the potential to impact areas of natural habitat and the heart and lungs of humans.
