Update: Obenshain, Herring in dead heat for Va. AG

RICHMOND, Va. (Legal Newsline) -- With nearly all of Virginia's voting precincts reporting, Republican Mark Obenshain is in a dead heat with Democrat Mark Herring for state attorney general.

As of 9:30 a.m., 99.92 percent of the state's precincts had reported -- that is, 2,556 of 2,558.

Herring, a state senator, is leading Obenshain with 49.91 percent of the vote, or 1,098,418.

According to the Virginia Board of Elections' website, Obenshain, also a state senator, has 49.88 percent of the vote, or 1,097,877 votes.

The race looks headed for a recount, The Washington Post reported early Wednesday morning.

Virginia law allows the trailing candidate to request a recount if the margin is less than 1 percent of the total vote.

Late Tuesday night, it appeared as though Obenshain was headed for victory.

Republicans have won the previous five elections for Virginia attorney general.

The winner of the election will take over for Republican Attorney General Ken Cuccinelli, who lost to Democrat Terry McAuliffe in the race for governor.
