TOLEDO, Ohio (Legal Newsline) - Ohio Attorney General Mike DeWine filed a lawsuit Tuesday against two Florida companies that operate Stanton Optical for allegedly engaging in multiple violations of state consumer laws.
Vision Value LLC and Marcarius, Max & Daniel LLC operate Stanton Optical, which has stores in Beavercreek, Miamisburg and Toledo. Stanton Optical sells contact lenses, eyeglasses, accessories and eye exams. The company uses special promotions such as buy one get one free offers and free eye exams in its advertisements to bring in customers.
DeWine's office, the Better Business Bureau and the Federal Trade Commission received 78 consumer complaints about Stanton Optical.
"Dozens of consumers reported a variety of problems with these stores," DeWine said. "Businesses have an obligation to treat consumers fairly, and when violations continue without correction, we will step in and take action."
Consumers allegedly waited months to receive their glasses after paying for them, did not receive refunds they were owed or received glasses with incorrect prescriptions.
DeWine's lawsuit alleges the defendants engaged in multiple violations of Ohio's Consumer Sales Practices Act, including failure to deliver, shoddy work and misusing the word free. The suit seeks to stop the defendants from future violations and obtain full consumer restitution, civil penalties and additional costs.
