MADISON, Wis. (Legal Newsline) - Wisconsin Attorney General J.B. Van Hollen announced a temporary judgment on Monday against the owners of a recreational vehicle resort and campground in Lodi.
Crystal Lake RV Resort LLC, Morgan RV Resorts LLC and Morgan Management LLC allegedly violated Wisconsin environmental laws resulting from the mismanagement of the Crystal Lake Resort's three wastewater treatment lagoons. The three companies, which have principal offices in Delaware and New York, allegedly failed to report and mitigate wastewater overflows.
On three separate occasions in spring 2008, 2009 and 2010, the Wisconsin Department of Natural Resources alleged that overflows of wastewater took place at the resort's treatment system. Overflow of wastewater from a treatment lagoon is prohibited because the overflow typically contains pollutants that could damage adjacent wetlands and waters. Additionally, the defendants allegedly failed to sample, monitor and report on the chemical content of the lagoons.
Columbia County Circuit Court Judge Alan White approved the agreement Oct. 9. Under the terms of the agreement, the defendants must pay $85,000 in statutory penalties, forfeitures, attorney fees and costs.
The defendants are no longer managing Crystal Lake Resort which has been placed under the control of a receiver. The receiver is working with the DNR to bring the resort into compliance with state environmental regulations.
