CONCORD, N.H. (Legal Newsline) - New Hampshire Attorney General Joseph Foster and Department of Environmental Services Commissioner Thomas Burack have announced an $84,000 court order against the owner of a salvage yard for alleged environmental violations.
On Friday, the Sullivan County Superior Court found James Bonia, the owner of Tri-State Car Crushing in violation of a previous consent decree related to his operation of the Lempster-based motor vehicle salvage yard. The court prohibited Bonia from ever again operating or owning a motor vehicle salvage yard in the state without prior approval. The court also imposed $84,000 in civil penalties that were previously suspended.
Foster's office alleged that Bonia failed to operate Tri-State Car Crushing in compliance with the prior consent decree and committed new violations of environmental regulations. The state alleged that Bonia buried solid waste on his property and brought solid waste onto the property without having the required permit to do so.
Foster's office first filed a lawsuit against Bonia in April 2008 for allegedly operating an unpermitted solid waste facility, failing to report and clean up spills of hazardous wastes and regulated substances, improperly managing and storing hazardous wastes and regulated substances, failing to perform groundwater monitoring and failing to protect wells from being damaged or buried.
