RICHMOND, Va. (Legal Newsline) -- State Sen. Mark Herring won the Democratic nomination for Virginia attorney general in Tuesday's state primary.

Herring beat out Justin Fairfax, a former federal prosecutor and small business owner, with nearly 52 percent of the vote, according to The Associated Press.

He will face another state senator, Republican Mark Obenshain, in Virginia's Nov. 5 election.

Incumbent Attorney General Ken Cuccinelli, a Republican, is running for governor rather than seek a second term as the state's top lawyer.
