N.H. AG announces proposed affiliation agreement between healthcare charitable trusts

CONCORD, N.H. (Legal Newsline) - New Hampshire Attorney General Joseph Foster announced the submission Monday of a proposed affiliation agreement involving two healthcare charitable trusts to his office for review.

Dartmouth-Hitchcock Health and New London Hospital Association submitted the proposed agreement pursuant to RSA 7:19-b, a law that regulates acquisition transactions between state healthcare charitable trusts. The two trusts submitted the proposed agreement to Foster's Charitable Trusts Unit.

If the proposed transaction is completed and agreed to, Dartmouth-Hitchcock will become the sole corporate member of New London Hospital Association and will obtain certain reserved powers over the governance and operation of New London Hospital.

Foster's Charitable Trusts Unit will conduct a review of the proposed agreement in accordance with New Hampshire law. Before the unit makes a final decision, Anthony Blenkinsop, the director of charitable trusts, will accept input from members of the public who wish to provide comment on the proposed affiliation agreement.

The Charitable Trust Unit will accept public comments via letter or email.
