A class-action lawsuit filed in Texas on Friday against three car dealerships and a major auto manufacturer alleges they refused to repair damage to Lexus and Toyota vehicles that was caused by hot weather.
Felicia Carter, Angellia Dozier and Nevalyn Farley filed the lawsuit against Westlex Corporation, which owns the Westside Lexus; McCall-TL, which owns Sterling McCall Lexus; Park Place LX of Texas, which owns Park Place Lexus Plano; and Toyota Motor Sales, U.S.A.
The dealerships sell and service Lexus luxury vehicles and Toyotas.
The suit alleges Texas' hot weather damaged the dashboards of vehicles sold by the dealerships.
A service bulletin issued by Toyota recognized the defect and instructed its dealerships to repair the damage. The suit alleges the dealerships refused to repair vehicles that were no longer covered by the
Lexus Comprehensive Warranty or Toyota Comprehensive Warranty.
The lawsuit asks the court to determine if there is an implied warranty between the dealerships and customers who purchased the vehicles, and if the dealerships should repair the damage caused by the Texas heat.
