DELAWARE, Ohio (Legal Newsline) - Ohio Attorney General Mike DeWine filed a lawsuit on Wednesday against a central and northeast Ohio laser liposuction business for allegedly engaging in deceptive and unfair business practices.
Wellness Laser and Med Spa LLC offers laser liposuction and other weight loss services from locations in Beachwood and Westerville. Five consumers filed complaints with DeWine's office and approximately 15 consumers filed complaints with the Better Business Bureau against Wellness Laser and Med Spa.
Consumers alleged that after paying $50 to several hundred dollars online for liposuction and other weight loss treatments, they had difficulty scheduling the treatments or receiving refunds. Wellness Laser and Med Spa allegedly attempted to sell consumers additional products instead of providing refunds.
“Our goal is to bring this business into compliance with Ohio’s consumer laws and to stop false advertisements,” DeWine said. “Consumers who buy products and services from a business deserve to receive those products and services in a timely manner. When they don’t, we encourage them to let us know about the problem so we can address it.”
DeWine's lawsuit alleges that Wellness Laser and Med Spa and Martina Flemings, the company's owner, engaged in multiple violations of the Consumer Sales Practices Act, including misrepresenting services, failure to deliver and providing poor customer service.
The lawsuit seeks consumer restitution, civil penalties and an injunction to stop future violations.
