HOUSTON – The man who sued Whataburger for putting onions on his burger filed suit against Sonic a year ago for also failing to hold the onions. 

Seeking up to $1 million in damages, Demery Ardell Wilson filed suit against Whataburger Restaurants on April 25 in Harris County District Court. 

Wilson claims that on July 24 he was at a Whataburger where he “ate a fast-food meal and got an allergic reaction due to onions present in it after requesting no onions.” 

Wilson alleges Whataburger negligently failed to properly test the food and warn him of the dangers.

“As a result of the incident, plaintiff sustained serious personal injuries for which he had to seek the care of medical professionals,” the complaint states. “Defendant failed to act in accordance with the appropriate standard of care causing plaintiff to suffer personal injuries. …

The suit claims Whataburger is “strictly liable for manufacturing defective and unreasonably dangerous food” it served to the public.

Whataburger answered the suit on May 16, asserting that Wilson “may have failed to use the degree of care and caution” that a reasonable person in similar circumstances would have. It also demands “strict proof” of Wilson’s claims.

“Defendant asserts that plaintiff may be malingering and/or exaggerating the nature and severity of his alleged injuries to inflate the amount of his alleged damages,” the company’s answer states. “Further, to the extent plaintiff has been or is malingering and/or exaggerating the nature and severity of his alleged injuries by continuing treatment to increase the amount of his medical expenses, defendant contends that said extended treatment is not medically necessary or reasonable.”

A search of court records shows Wilson sued Sonic last May claiming the vendor negligently failed to hold the onions on his burger, causing him to fall sick.

In court documents, Sonic also denies the allegations and demands proof with Wilson’s claims as well.
