Six Flags sued over processing fee on website

NEW YORK (Legal Newsline) - Class action lawyers hope to score a payday with a lawsuit against Six Flags Great Escape Lodge over what they say is an illegal fee charged to online bookers.

A class-action lawsuit was filed March 14 against Six Flags Entertainment Corporation in the United States District Court for the Northern District of New York. The plaintiffs, Heather Labrake and Stephanie Smith, allege that the company has been charging hidden fees to customers on its website in violation of the New York State Arts and Cultural Affairs Law § 25.07(4).

The law mandates that every operator of a place of entertainment must disclose the total cost of a ticket, inclusive of all ancillary fees that must be paid to purchase it. The price should not increase during the purchase process. 

However, according to the complaint, customers are quoted a fee-less price when they select a ticket on Six Flags' website, only to be charged a "Processing Fee" at checkout.

The plaintiffs seek relief individually and on behalf of all other customers who bought tickets from Six Flags using its website for actual and/or statutory damages, reasonable attorneys’ costs and fees, and injunctive relief under New York Arts and Cultural Affairs Law § 25.33.
