Lawsuit alleges Enfamil formula is dangerous for premature babies

CHICAGO (Legal Newsline) - The maker of baby formula faces a federal lawsuit that alleges premature babies are being harmed.

Heidi Paul, acting as the natural guardian and personal representative of the Estate of C.P., filed a lawsuit Dec. 6 against Mead Johnson & Company, LLC. The case was filed in the United States District Court for the Northern District of Illinois. 

The complaint alleges that Mead Johnson's infant formula products caused a severe disease known as Necrotizing Enterocolitis (NEC) in her premature infant, C.P., who was fed with Enfamil Premature. NEC is a catastrophic injury and often deadly disease that largely affects premature and/or low birth weight newborns/babies, the suit says. 

The lawsuit accuses Mead Johnson of negligent, willful, and wrongful conduct in connection with the design, development, manufacture, testing, packaging, promoting, marketing, distribution, labeling, and sale of its bovine-based formulas known as Enfamil and/or Enfamil Premature. 

Heidi Paul alleges that despite well-known scientific studies establishing the increased risk of NEC when these products are administered to premature infants, Mead Johnson knowingly withheld this information from consumers.

The plaintiff is represented by Christopher LoPalo of Napoli Shkolnik's Puerto Rico office.
