NEW YORK (Legal Newsline) – Black & Decker faces a proposed class action complaining that certain models of trimmers push too much string out, causing bits to go flying dangerously.

Graham Waldo, individually and on behalf of all others similarly situated, filed a complaint Oct. 6 in the U.S. District Court for the Eastern District of New York against Black & Decker U.S. Inc., alleging breach of implied warranty of merchantability and other claims.

According to Waldo's class action, he purchased a Black & Decker string trimmer from a Home Depot in San Pedro, Calif., on March 31. He claims that while using the product, he suffered "a painful laceration" on his lower leg due to too much string being automatically released from the spool.

Waldo alleges the dangerous defect with the trimmer caused too much string to be advanced and for pieces to become projectiles. He further alleges that despite many consumer physical injuries due to the defect, Black & Decker has failed to recall the products or offer reimbursement to consumers.

Waldo and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Alexander Wolf of Milberg Coleman Bryson Phillips Grossman in Beverly Hills, California.
