Class action complains apple is main fruit in Beliv nectar drinks

WEST PALM BEACH, Fla. (Legal Newsline) — A Florida class action lawsuit says a line of nectar drinks made by Beliv violates consumer protection laws.

Irone Merrick, individually and on behalf of all others similarly situated, filed a complaint Sept. 11 in Palm Beach County Circuit Court against Beliv LLC, alleging violation of the Florida Deceptive and Unfair Trade Practices Act and other claims. 

Merrick alleges she purchased Beliv's Petit Nectar drinks at various stores in Florida. She claims that despite the labeling on drinks - which includes pictures of strawberries and bananas - the product's primary fruit ingredient is "concentrated apple pulp" and is misleading for consumers. 

Merrick alleges that the product contains juice from fruits other than those "named or implied on the label" and that Beliv fails to disclose the apple blend or blend of other fruit juices. She further alleges the label omits that the apple juice is the drink's predominant juice when the label shows strawberry and banana but no apple. 

Merrick claims the strawberry and banana are only present as "flavors or flavorings," which deceives consumers.  

Merrick and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by William Wright The Wright Law Office PA in West Palm Beach.
