Lawsuit blames Boston Hyatt for teen girl's shooting death

BOSTON (Legal Newsline) — A Hyatt hotel in Boston that allegedly allowed underage partying in its rooms is facing a lawsuit after a fatal shooting.

Diva Duarte, individually and as personal representative of the Estate of Nalijah Andrade, filed a complaint Aug. 29 in Suffolk County Superior Court against Hyatt Corporation and SHSP TRS Boston II LLC, doing business as Hyatt Regency Boston, alleging wrongful death and other claims. 

According to Duarte's complaint, her daughter Nalijah accompanied three other minor females to the Hyatt Regency Hotel on Avenue de Lafayette in Boston on Feb. 4, 2021, at the invitation of four males who rented several rooms at the hotel for the night. She claims the males had been "drinking, smoking pot and playing with a gun." 

Duarte alleges that none of the males had a license to carry or possess a firearm, but one of the males brought the gun into the hotel room. She claims the gun discharged and fatally struck her daughter in the head. 

Duarte alleges the Hyatt Regency was issued citations from the Boston Police for two previous incidents at the hotel including robbery and prostitution on the premises. She further alleges the defendants had inadequate security and allowed underage partying at the hotel that caused her daughter's death.

Duarte seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Steven Sabra of The Sabra Law Offices in Somerset. 

A grand jury ruled the shooting a homicide.
