Lawsuit alleges stroller's defective frame can cause infants to fall

BROOKLYN, N.Y. (Legal Newsline) — The manufacturer of the "Mockingbird" brand strollers is facing a class action lawsuit alleging the strollers are defective and pose a serious risk to infants.  

Fjona Dajlani and Allision Egan, individually and on behalf of all others similarly situated, filed a complaint May 4 in the U.S. District Court for the Eastern District of New York against Baby Generation Inc., alleging fraud and other claims. 

The plaintiffs claim Baby Generation's "Mockingbird" branded single-to-double strollers and single strollers are defective. They allege the strollers "do not meet minimum standards of operating" or have the necessary level of safety because of the unstable frame that causes the strollers to crack and children to fall from the strollers. 

The plaintiffs further allege Baby Generation, instead of providing a refund to customers, only offers a frame reinforcement kit through a recall which does not prevent the main components of the stroller from continuing to crack, degrade or cause injury to children. The plaintiffs claim consumers have overpaid for the strollers based on the misrepresentations that the strollers are safe for transporting children. 

They also claim Baby Generation fraudulently represented the strollers are safe when they could cause severe injury to a child or newborn. 

The plaintiffs and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Laurence King, Matthew George and Blair Reed of Kaplan Fox & Kilsheimer LLP in Oakland, Calif., and Marc Wites of Wites & Rogers in Lighthouse Point, Fla.
