Lawsuit alleges Vick's Vapo adult, children's formulas have same ingredients yet different prices

LOS ANGELES (Legal Nwsline) — A California woman alleges Vick's adult and children Vapo product labels are misleading because they contain similar ingredients. 

Gabriela Mendoza, on behalf of herself and all others similarly situated filed a complaint Feb. 23 in the U.S. District Court for the Central District of California against The Procter & Gamble Company alleging violations of California's Unfair Competition Law and other claims. 

Mendoza alleges in her class action that she purchased Children's VapoRub and Children's VapoPatch products at CVS and Walmart stores in Monterey, California. She claims the Vapo products' labeling is misleading because they are labeled "adult" and "children's" when they contain identical or "substantially similar" ingredients. 

Mendoza further claims Procter & Gamble fails to disclose the children's products are pharmacologically identical to the adult's products and the children's products are sold at a higher price. She alleges Procter & Gamble's misrepresentations and omissions lead consumers to believe there is something different about the Vapo products, including that the children's products are more appropriate for children. 

Mendoza and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Ronald Marron, Michael Houchin and Lilach Halperin of The  Law Offices of Ronald A. Marron in San Diego, California.
