Suit alleges Capri Sun juice contains toxic chemicals, falsely labeled 'all natural'

CHICAGO (Legal Newsline) — A consumer class action lawsuit alleges Kraft's Capri Sun juice drink is fraudulently labeled as all natural when it contains synthetic chemicals. 

Alexandra Toribio, individually and on behalf of all others similarly situated, filed a complaint Nov. 29 in the U.S. District Court for the Northern District of Illinois against The Kraft Heinz Company alleging violation of the New York Deceptive Trade Practices Act and other claims. 

Toribio claims in her class action that Kraft has deceptively labeled and marketed its Capri Sun Strawberry Kiwi juice drink as containing "all natural ingredients" when it actually contains polyfluoroalkyl (PFAS) substances, which are synthetic chemicals. She further claims that the CDC has stated that PFAS exposure has been linked to cancer, liver damage, decreased fertility as well as an increased risk for asthma and thyroid disease. 

Toribio alleges that Kraft's representations falsely lead consumers to believe Capri Sun is a healthy and all natural juice drink when it contains toxic "man-made chemicals" that pose numerous health concerns. She also alleges Kraft has intentionally misled consumers in order to drive sales, increase profits and target health-conscious consumers. 

Toribio also alleges Kraft falsely and deceptively advertises the product is made from "filtered water" which also leads consumers to believe the drink is free from impurities and chemicals. 

Toribio and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by lawyers at Milberg Coleman and The Sultzer Law Group.
