CHICAGO (Legal Newsline) – Dunkin' Brands is accused of misrepresenting its blueberry doughnuts by an Illinois consumer.

Bartosz Grabowski filed a complaint on July 9 in the U.S. District Court for the Northern District of Illinois, Eastern Division against Dunkin' Brands Inc. alleging violation of the Illinois Fraud and Deceptive Business Practices Act.

According to the complaint, the plaintiff alleges that he purchased a glazed blueberry doughnut from Dunkin' Donuts in Chicago in December 2016. He alleges he belived the doughnut contained blueberries when the product actually uses imitation blueberries that resemble the real thing. He claims he would have not purchased the product or paid significantly less had he known the product did not contain actual blueberries.

The plaintiff requests a trial by jury and seeks all compensatory damages, punitive damages, interest, restitution, attorneys' fees and further relief as the court deems equitable and just. He is represented by Thomas M. Ryan of Law Office of Thomas M. Ryan PC in Chicago.
